DEFINITIONS

 

For the purposes of this Privacy Notice, terms with initial capital letters shall have the meaning indicated below:

 

Privacy Notice: Document by which Whiskey Content, S.C. informs the Data Subject about the processing of their Personal Data.
Personal Data: Any information concerning an identified or identifiable natural person.
Sensitive Personal Data: Information that affects the Data Subject’s most intimate sphere, such as ethnic origin, health status, image, voice, beliefs, biometric data, among others.
Data Subject: The natural person to whom the personal data pertains.
Controller: Whiskey Content, S.C., who decides on the processing of personal data.
Processor: The person who processes the data on behalf of the Controller.
Processing: Any operation involving the data: collection, use, access, storage, or disclosure.
Transfer: Communication of data to third parties other than the Controller or Processor.
ARCO Rights: Rights of Access, Rectification, Erasure, and Objection to data processing.
LFPDPPP: Federal Law on the Protection of Personal Data Held by Private Parties.

 

1. IDENTITY AND ADDRESS OF THE CONTROLLER

 

Whiskey Content, S.C., a civil company legally incorporated under Mexican law, with registered office at Calle Palenque 395, PB Int Oficina 2, Colonia Vertiz Narvarte, Delegación Benito Juarez, C.P. 03600, Mexico City, is responsible for the processing of personal data it collects within the framework of its activities as an audiovisual production company, including film, television, advertising campaigns, corporate videos, and digital content.

 

2. PURPOSES OF PERSONAL DATA PROCESSING

 

A. Employees and Collaborators:

• Integration of employment files. • Hiring, payroll, payment of fees and benefits.
• Performance evaluation.
• Access to facilities and systems.
• Compliance with tax, labor, and social security obligations.
• Use of image for internal or institutional purposes (with prior express consent).

 

B. Suppliers, Contractors, and Freelancers:

• Professional identification and tax validation.
• Execution and execution of contracts.
• Payment management, invoicing, and accounting.

C. Artists, Actors, Talents, and Participants in Audiovisual Projects:

• Payment of royalties or contractual compensation.

 

D. Clients, Co-producers, Agencies, and Service Buyers:

• Identification and validation of contact information.
• Preparation and execution of production, creative services, or licensing contracts.
• Communication for project monitoring, invoicing, deliverables, and reviews.
• Compliance with legal, tax, and administrative obligations.
• Safekeeping of information for business history and future contractual relationships.
• Sending proposals, quotes, presentations, or commercial invitations.

 

3. PERSONAL DATA COLLECTED

 

We may collect:

Identification: name, address, email, telephone number, CURP (Tax ID Number), RFC (Financial Identification Number), signature, official identification.
Academics and professionals: experience, studies, references, reels, biographical profile, portfolios.
Tax and banking: CLABE, account number, tax certificate, billing.
Employment or contractual: Contracts, evaluations, performance, incidents.
Audiovisual/sensitive: Image, voice, appearance, physical characteristics, ethnic origin, only with express written consent.

 

4. DATA TRANSFERS

 

Whiskey Content, S.C. may transfer data without requiring consent in the following cases:

• To tax, labor, administrative, or judicial authorities.
• To banking institutions for payment processing.
• To clients, co-producers, or distribution platforms, if the data subject’s participation requires it and under contractual confidentiality measures.
• To casting agencies, representatives, or commercial partners for project operational purposes.

 

4 BIS. LEGAL BASIS FOR PROCESSING

 

Express consent: for financial, sensitive, or image/voice data.
Execution of contract: when the processing arises from a legal relationship.
Legal obligation: for compliance with tax, labor, and social security laws.
Legitimate interest: for file preservation, logistical coordination, and dissemination in accordance with contracts.
Transfers authorized by law: in accordance with Article 37 of the LFPDPPP.

 

5. SECURITY MEASURES

 

Whiskey Content, S.C. implements physical, technical, and administrative measures to protect personal data against damage, loss, alteration, unauthorized use, or unlawful processing, in compliance with the security principle of Article 19 of the Law.

 

6. ARCO RIGHTS AND REVOCATION OF CONSENT

 

The Data Subject may exercise their rights of Access, Rectification, Cancellation, or Opposition to processing by sending a request to info@whisky.film, including:

• Full name and contact information.
• Current official identification. • Relationship with the company.
• Description of the right to exercise.
• Supporting documents (if applicable).

 

The response will be issued within a maximum of 20 business days, in accordance with Article 32 of the Law.

 

7. DATA RETENTION

 

The data will be retained only for the time necessary to fulfill the stated purposes and in accordance with applicable tax, labor, and legal provisions. They will then be blocked or deleted.

 

8. USE OF TRACKING TECHNOLOGIES ON WEBSITES

 

Our website www.whisky.film may use cookies or other technologies to improve the browsing experience. The user can disable them in their browser. The information collected may include IP address, approximate location, browser, and operating system.

 

9. CHANGES TO THE PRIVACY NOTICE

 

Any changes to this notice will be published on www.whisky.film or communicated by the means determined by the Data Controller. The Data Subject is advised to periodically consult this notice.

 

10. CONSENT

 

The Data Subject acknowledges having read this Privacy Notice and, unless otherwise stated, gives their tacit consent for the processing of their data. For sensitive, financial, image, or voice data, express written consent will be required, in accordance with Articles 8 and 9 of the Law.

II. WHAT DATA DO WE COLLECT FROM YOU?

At Whiskey, we collect and process various types of personal data in accordance with our operational and legal needs. Below, we describe the types of data we may collect from different stakeholders:

1. for our employees and collaborators, we collect personally identifiable data, such as name, address, email address, telephone number, photograph and signature. We also obtain employment information, including employment history, performance evaluations, payroll details and employment contracts. In addition, we manage security data, such as facility and system access logs, as well as tax and social security information. Finally, we use images, such as photographs and videos, for internal or institutional purposes, always after obtaining express consent.

2. With respect to suppliers, contractors and freelancers, we collect professional data including name, address, e-mail, telephone and professional identification. We also collect tax information, tax receipts, and contractual data related to service agreements. We also manage financial information, such as bank account details and payment and billing records.

3. In the case of artists, actors, talents and participants in audiovisual projects, we collect identification data such as name, age, nationality and contact. We obtain professional information including experience, profile and portfolio, as well as the use of image and voice in recordings, photographs and videos. We also manage contractual data related to participation agreements and broadcast and distribution terms.

4. For clients, co-producers, agencies and buyers of services, we collect contact data, such as name, company, address, e-mail and telephone. In addition, we collect contractual information related to service contracts, licensing and co-production agreements. We also manage financial and tax information, including billing data and payment history, and business data covering project history, communications and business proposals.

III. WHAT DO WE USE YOUR PERSONAL DATA FOR?

In Whiskey, the processing of your personal data is carried out with the utmost respect for your privacy and in compliance with the regulations in force in Colombia. Below, without prejudice to those indicated in our Personal Data Processing Policy, we detail the specific purposes for which we use your personal data, depending on the relationship you have with us:

Distribution, broadcasting and synchronization of content in national and international media.
Management of royalty payments or contractual considerations.

Purposes Clients, Co-Producers, Agencies and Buyers of Services.

Identification and validation of contacts for the development of effective business relationships.
Development and execution of production, creative services or licensing contracts.
Maintaining communication for project tracking, invoicing, deliverables and reviews.
Ensuring compliance with legal, fiscal and administrative obligations.
Safeguarding of information for the creation of a commercial history and the strengthening of future contractual relationships.
Sending proposals, quotations, presentations or commercial invitations for the promotion of services and products.

IV. WHAT RIGHTS DO YOU HAVE AND HOW CAN YOU EXERCISE THEM AS A DATA SUBJECT?

At Whiskey, we value your right to protect and control your personal data. Therefore, we want you to know what rights you have as a Data Subject and how you can exercise them. Here we explain it to you in a simple way:

1. Know, update and rectify your personal data: You can request it against the Controllers or Processors. This right is applicable if the data is partial, inaccurate, incomplete, fractioned, misleading, or if its processing is prohibited or has not been authorized.
2. Request proof of the authorization granted: You may request evidence of the authorization you gave for the processing of your data, except in cases where the law does not require it, according to Article 10 of Law 1581 of 2012.
3. Be informed about the use of your personal data: Upon request, you may ask the Data Controller or Data Processor to inform you about how your personal data has been used.
4. File complaints with the Superintendence of Industry and Commerce: If you consider that the provisions of the data protection law have been violated, you can file a complaint with this entity.

5. Revoke the authorization and/or request the deletion of your data: You can do so if the principles, rights and constitutional and legal guarantees are not respected in the processing of your data. This will proceed when the Superintendence of Industry and Commerce determines that the Responsible or Responsible party has incurred in conduct contrary to the law and the Constitution.
6. Free access to your personal data: You have the right to access free of charge to your personal data that have been processed.

We understand that you may change your mind and we want to make the process easier for you. At any time, you can revoke the consent you have given us for the processing of your personal data, and we will stop using it.
